Terms of Service

These Terms of Service ("Terms") govern your access to and use of the MConnect communications platform, APIs, and related services ("Services"). By accessing or using the Services, you agree to be bound by these Terms.

1. Account Registration

You must create an account to access the Services. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You must provide accurate, current, and complete information during registration.

2. Service Usage

You may use the Services only in compliance with these Terms and all applicable laws, including WhatsApp Business Messaging policies and data protection regulations. You shall not:

  • Use the Services for any unlawful purpose or in violation of any regulation
  • Send unsolicited messages or spam through the platform
  • Attempt to circumvent rate limits, access controls, or security measures
  • Use the Services in a way that could harm, degrade, or impair the platform

3. Fees and Payment

Fees for the Services are outlined in your service agreement or order form. All fees are non-refundable except as expressly stated. We may change our fees with 30 days notice. Late payments may result in service suspension.

4. Data Protection

We process customer data in accordance with our Privacy Policy. You retain all rights to your content. We implement industry-standard security measures to protect your data. We will not access or use your customer's data except as necessary to provide the Services.

5. Service Level Agreement

We commit to 99.9% API availability measured monthly. Credits are issued for verified downtime exceeding the SLA threshold. Scheduled maintenance is excluded from uptime calculations and will be notified at least 48 hours in advance.

6. Limitation of Liability

To the maximum extent permitted by law, MConnect shall not be liable for indirect, incidental, special, consequential, or punitive damages arising out of or relating to the Services. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.

7. Term and Termination

These Terms remain in effect for the duration of your account. Either party may terminate for material breach with 30 days notice. We may suspend access for violations of these Terms or applicable law. Upon termination, your data will be available for export for 30 days.

8. Changes to Terms

We may modify these Terms at any time with 30 days notice via email or platform notification. Continued use after changes take effect constitutes acceptance. If you do not agree, you may terminate your account before the changes take effect.
